The overseers of the redevelop­ment of the South Weymouth Naval Air Station and 10 Weymouth residents who want to halt the develop­ment will return to court next week.

 

In October, a superior court judge denied a request by the resi­dents to stop development at the base until the developer got a better handle on the environmental con­tamination there.

 

Base overseers South Shore Tri-Town Development Corp. followed the judge's decision by filing a motion to dismiss the complaint. If Tri-Town's request is granted, the case brought by the residents would be closed.

 

The residents requested a hear­ing on Tri-Town's request, which will take place Wednesday in after­noon Norfolk County Superior Court.

 

Tri-Town attorney Mary Ryan said the action is the next step typi­cally taken after a judge rules against an injunction request.

 

"The fact that the preliminary injunction is denied doesn't get rid of the case," Ryan said. "The court denied it and did it in language that indicates there's no merit. We don't think the case should even be on the books anymore."

 

The residents' request for injunc­tion concerned the first phase of de­velopment that has already begun at the base, which includes rebuilding the entranceway and making improvements to roadway and in­frastructure.

 

In requesting the Wednesday hearing, the defendants stated in court papers that Tri-Town is trying to "force several unwanted negative impacts upon the host communities, in particular Weymouth, without full disclosure."
