superior court judge denied a request by the residents to stop development at
the base until the developer got a better handle on the environmental contamination
there.

South Shore Tri-Town Development Corp. followed the judge's decision by filing
a motion to dismiss the complaint. If Tri-Town's request is granted, the case brought
by the residents would be closed.
The residents
requested a hearing on Tri-Town's request, which will take place Wednesday in
afternoon Norfolk County Superior Court.
Tri-Town attorney
Mary Ryan said the action is the next step typically taken after
a judge rules against an injunction request.
"The fact that
the preliminary injunction is denied doesn't get rid of the case," Ryan
said. "The court denied it and did it in language that indicates there's
no merit. We don't think the case should even be on the books anymore."
The residents'
request for injunction concerned the first phase of development that has
already begun at the base, which includes rebuilding the entranceway and making
improvements to roadway and infrastructure.
