                                                   TOWN OF ABINGTON
                                 COMMONWEALTH OF MASSACHUSETTS
                                              SPECIAL TOWN MEETING

PLYMOUTH, SS.

To either of the Constables of the Town of Abington . . .

GREETINGS. In the name of the Commonwealth of Massachusetts you are hereby
directed to notify and warn the inhabitants of said Town, who are qualified to vote
in Town affairs, to meet in
                                            ABINGTON HIGH SCHOOL
                               201 RICHARD FRANCIS GLINIEWICZ WAY
                     IN PRECINCT FOUR IN SAID ABINGTON, ON MONDAY,
                       THE 2ND OF APRIL, 2007, AT 7:00 IN THE EVENING

Then and there to act on the following articles:

Article 1: To see if the Town will petition the General Court to amend the Abington
Home Rule Charter, being c. 259 of the Acts of 2004, by:

     1. Amending Article III, Elected Officials, Section 3-1, General
         Provisions, by striking the term "board of health";

     2. Amending Article III, Elected Officials by striking Section 3-7,
         Board of Health and renumbering the remainder of said Article
         accordingly;
     
     3.  Amending Article V, Administrative Organization, by inserting the
          following new section:

Section 5-7                          Board of Health

There shall be a board of health which shall consist of five (5) members appointed
by the Board of Selectmen for terms of three years each, so arranged that the term
of office of as nearly an equal number of members as is possible shall expire each
year. The board of health shall be responsible for the formulation and enforcement
of rules and regulations affecting the environment and the public health, and shall
have all of the powers and duties which are given to boards of health under the
constitution and laws of the Commonwealth of Massachusetts, and such additional
powers and duties as may be authorized by the charter, by by-law or by other vote
of the town meeting, except as otherwise provided for in this Charter, by by-law or
by other vote of the town meeting.
To facilitate the transition from the elected board of health to the appointed board
of health, the current elected members in office as of the effective date of the
amendment to the Charter calling for an appointed board of health shall continue
to serve until the expiration of their elected term. Any expiration of an elected
term shall be filled by appointment by the Board of Selectmen as provided for
herein. Any vacancy arising on said board shall be filled by appointment by the
Board of Selectmen for the remainder of said term.    

        4.  Amending Article VIII, Section 8-4, Time of Taking Effect, by
             adding a new sub-section (f) as follows:

(f) The current elected members of the board of health in office as of the effective
date of the amendment to the Charter calling for an appointed board of health shall
continue to serve until the expiration of their elected term. Any expiration of an
elected term shall be filled by appointment by the Board of Selectmen as provided
for in said Charter amendment. Any vacancy arising on said board shall be filled by
appointment by the Board of Selectmen for the remainder of said term, or take any
other action relative thereto.                                                                  -

The Finance Committee recommends appoval of this article.  This represents the
Town's solution to ensuring the continuity of operations at the Board of Health

Town Meeting voted NO on this article

Article 2: To see if the Town will vote to transfer from available funds the sum of
One Thousand Six Hundred Sixty Eight Dollars and Sixty Six Cents ($1,668.66) for
an unpaid bill for retired Fire Chiefs Medical bills incurred during prior Fiscal
Years, or take any other action relative thereto.

The Finance Committee recommends appoval of this article and recommends Town
Meeting support a transfer from the Health Insurance Budget the sum of $1,668.86 to
fund this unpaid bill

Town Meeting approved this article unanimously   

Article 3: To see if the Town will vote to transfer from available funds the sum of
Seven Hundred Thirty Seven Dollars and Ninety Cents ($737.90) for an unpaid legal
bill for legal services incurred during a prior fiscal year, or take any other action
relative thereto.

Article 4: To see if the Town will vote to transfer from available funds the sum of Two
Thousand Ninety Five Dollars ($2,095.00) for an unpaid bill for a prior fiscal year to
North River Collaborative for reimbursement of Medicaid payment billings, or take any
other action relative thereto.

Article 5: To see if the Town will vote to authorize the Water Commissioners to
transfer from the Systems Development Account the sum of Fifty Thousand Dollars
($50,000.00) for the purpose of supplementing the repair account, or take any other
action relative thereto.
                                       BY WATER COMMISSIONERS

Article 6: To see if the Town will vote to authorize the Water Commissioners to
transfer from the Water Systems Development Account the sum of Twenty Five
Thousand Dollars ($25,000.00), with a like amount from the Town of Rockland, for
replacement of the filter media at the Myers Avenue Water Treatment Plant, or take
any other action relative thereto.

Article 7: To see if the Town will vote to authorize the Water Commissioners to
transfer from the Water Systems Development Account the sum of Seventy Five
Thousand Dollars ($75,000.00) for engineering of the water main replacement
program to be funded by the Massachusetts Water Abatement Trust Fund, or take any
other action relative thereto.

Article 8: To see if the town will vote to authorize the Water Commissioners to take
from the Water Systems Development Account the sum of Two Thousand Dollars
($2,000.00), with a like amount from the Town of Rockland for payment of FY06 bill
from the Department of Environmental Bureau of Waste Site Cleanup, or take any
other action relative thereto.
                                       BY WATER COMMISSIONERS

Article 9: To see if the Town will vote pursuant to the authority granted under MGL
Chapter 71, Section 7IF to establish a revolving fund with an affectivity date of July 1,
2006, for the purpose of providing nonresident educational Special Education
programming to be funded by tuition collection during FY2007. Not more than One
Hundred Fifty Thousand Dollars ($150,000.00) shall be expended from this fund during
a fiscal year. The School Committee or their designees shall be authorized to expend
from this fund, or take any other action relative thereto.
                                      BY SCHOOL COMMITTEE
Town Meeting voted no on Article 1 and against the
recommendation of the Finance Committee.

Town Meeting approved Articles 2 through Article 9 unanimously.
